PLEASE READ THESE TERMS OF USE AND PRIVACY POLICIES OF PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S, LOCATED IN BOGOTÁ AT CRA 16 A # 85 – 77 (MAIN OFFICE) AND AT www.siu-tutuava.com, BEFORE USING THIS WEBSITE TO BUY ANY PRODUCT OR SERVICE FROM SIU TUTUAVA AND ITS POINTS OF SALE.

GENERAL CONDITIONS

These Terms and Conditions constitute an agreement (the “AGREEMENT”) between PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S (the “company” or “we”) and you (the “USER”), who browses the website SIU-TUTUAVA.COM and/or visits our physical points of sale. This agreement sets out the legal terms and conditions governing your use of the platform (collectively referred to here as the “SITE”) and your purchase and/or use of any goods and services from PROMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S (collectively referred to hereinafter as the “OFFERINGS”).

Your use of the site and of all information, data, text, software, images, sounds or other materials contained herein, and your use or purchase of any other OFFERING, confirms your unconditional agreement to abide by this AGREEMENT and is subject to your continued compliance with its terms and conditions. If you do NOT agree to abide by this AGREEMENT, do not access or use the SITE and do not take part in any of the WEB OFFERINGS OR IN ITS POINTS OF SALE.

If you, the USER, are dissatisfied with the SITE or with other OFFERINGS AND/OR POINTS OF SALE, your sole and exclusive remedy is to stop using the SITE or the OFFERINGS AND/OR ITS POINTS OF SALE.

Every order placed on this SITE (points of sale) or in the online shop (the “ONLINE SHOP”) of PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S necessarily entails, as an essential, decisive and indispensable condition, the USER's unreserved acceptance of the GENERAL CONDITIONS of sale of the ONLINE SHOP of this SITE in force on the day the corresponding order is placed. The USER further acknowledges that acceptance of these conditions entails their application to the order they refer to as well as to every subsequent order, except where new conditions are brought to their attention by the ONLINE SHOP OF PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S. The fact that the ONLINE SHOP OF SIU TUTUAVA does not invoke any of these conditions at a given moment may not be interpreted as, nor amount to, a waiver of its right to invoke them in the future or in the past.

The interpretation and performance of these conditions, as well as all acts arising from them, shall be governed by Colombian law, save where there are public-policy provisions to the contrary.

AMENDMENTS

SIU TUTUAVA S.A.S reserves the right to amend these TERMS AND CONDITIONS at any time and without prior notice. Any amendment shall take effect and be binding on USERS from the moment it is published on the PORTAL. Consequently, the USER should review these TERMS AND CONDITIONS each time they access the PORTAL.

Likewise, any notices, regulations, circulars or instructions of any nature issued by SIU TUTUAVA S.A.S, published on the PORTAL and related in any way to access to, browsing of or use of the PORTAL, or to access to and use of the products and/or services offered on it, shall form an integral part of these TERMS AND CONDITIONS.

PRODUCTS

The offers presented by the ONLINE SHOP of SIU TUTUAVA.COM are valid while stocks last and within the dates established for each offer. The online shop of SIU TUTUAVA.COM reserves the right to modify its product range in response to difficulties imposed by its suppliers.

The photographs, graphics and descriptions of the products offered for sale are indicative only and in no way bind the ONLINE SHOP OR THE POINTS OF SALE OF PROMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S.

SHIPPING AND CARRIAGE

Products purchased will be delivered to the address given when registering on the SITE. No support is provided for any purchased product on Saturdays, Sundays or public holidays. Orders will be shipped by our own PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S courier staff and by private courier companies contracted by PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA. Should any difficulty arise with the shipment, you will be notified by telephone, email or whichever channel you used to contact us.

USER REGISTRATION

You represent and warrant that you are at least eighteen (18) years of age or, if you are under eighteen (18), that you are at least thirteen (13) years old and are accessing the SITE with the knowledge of a parent or legal guardian, who is also deemed to agree to this AGREEMENT. Certain features of this SITE (including, but not limited to, user registration) and certain OFFERINGS may be subject to the age of majority and/or other eligibility requirements.

PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S products and business opportunity may not be offered, shipped or sold to a country outside Colombia without prior approval from PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S.

PURCHASE AND DELIVERY PROCESS IN THE PHYSICAL SHOP

Orders placed by telephone are subject to the following requirements: the user is not bound by minimum or maximum quantities. The delivery charge is $8,000 Colombian pesos. Nationwide, the delivery charge is approximately $12,000 to $25,000 Colombian pesos (depending on the city).

Note: shipping rates or delivery charges are subject to change as required by PROMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S.

ONLINE SHOP PURCHASE PROCESS

To buy from the ONLINE SHOP OF SIU-TUTAVA.COM you do not need to be a registered user. Add all the products you want to your cart, enter the details required for delivery and then click “Complete purchase” to place your order.

Shipping charges for products bought through www.siu-tutuava.com are as follows: $8,000 Colombian pesos in Bogotá and $9,000 for the southern zones of Bogotá; nationwide shipments cost approximately $12,000 to $25,000 Colombian pesos.

Finally, you will need to choose your payment method: AvalPay, a payment gateway from Grupo AVAL, which allows payment by debit or credit card, PayPal or bank transfer, Baloto, Efecty, Paga Todo, etc.

ORDER CANCELLATION OR RETURNS

An order may be cancelled provided it has not yet been shipped. If the product has already been shipped, the costs arising from that return (outbound and inbound) shall be borne by the customer. If the customer wishes to make the return at the physical shop, there will be no return cost provided the product has not been handled and no change has been made to its labelling, seal or packaging.

In accordance with the foregoing, and bearing in mind the consumer's right of withdrawal, the consumer must return the product to PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S in the same condition in which it was received, pursuant to article 47 of Law 1480 of 2011, within the exceptions applicable to perishable products as established by the Colombian Superintendence of Industry and Commerce.

Should the goods arrive broken or defective, PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S will bear the cost of collecting the product and will replace it with an identical one or one with the same characteristics.

Conditions for returns:

  • The product must not be damaged or deteriorated by the customer's own actions.
  • The product must have its labels and security seals.
  • Both the contents and the packaging must match the batch and expiry date of the product delivered.
  • Original accessories and packaging (including manuals, instructions for use, warranty certificates, etc.).
  • The product must not bear seals, stickers or anything written on it by the customer.
  • The product must show no signs of use, dirt or wear.
  • The product must be handed over within 24 hours, or at the latest within the 5 working days following delivery.
  • If you have already received the product and the delivery courier is still present when you request withdrawal or a return, you must hand the product to the courier for its return.
  • The staff responsible for collecting the product are not authorised to dismantle or handle it; their sole role is to deliver or collect it.
  • If the product is not packed in its original packaging, collection will not proceed.
  • For products outside Bogotá, if the return is accepted, PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S will bear the collection cost.
  • The product must be exchanged for one of equal or greater value.

Note: remember that for any claim you must have your purchase invoice to hand, legible and in good condition (we recommend making a copy of it).

YOUR INFORMATION AND PRIVACY

In accordance with article 4 of STATUTORY LAW 1581 OF 2012 on the Protection of Personal Data, you are informed that the personal data provided to this company, whether by the data subject themselves or by a person authorised by them, will be incorporated into duly registered automated files for which PROMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S is responsible, that such data are necessary for the contractual relationship, and that their purposes are the proper development, monitoring and fulfilment of the services contracted.

If you provide information to the SITE, you agree to provide accurate, up-to-date and complete information about yourself wherever it is requested, and you agree to maintain and update that information appropriately. We will use and keep the information we collect from you through the SITE in order to let you know about our new products and about promotions that may interest you.

The decision to provide this information is entirely voluntary and optional; however, if you decide not to provide it, you may not be able to access certain content or take part in certain features of the SITE.

Under the tax rules of Law 2010 of 2019 issued by the DIAN (the Colombian tax authority), an electronic invoice must be issued, and therefore the following details are required: tax ID (NIT) or national identity number, first name and surname, company name, address, a valid email address and a telephone number.

If you register on the SITE, you agree to accept responsibility for all activity that takes place within your account, email address or password, if any, and you agree not to sell, transfer or assign your password, any rights over it, or any email address issued by the SITE.

You are responsible for keeping your password confidential, if you have one, and for restricting access to your computer so that others cannot reach the portion of the SITE protected by that password or by the email address issued to you by the SITE using your full or partial name. We may, at our sole discretion and at any time.

PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S guarantees the confidentiality of the personal data held in its files and will adopt the regulatory measures needed to prevent, as far as possible, their alteration, loss, unauthorised processing or unauthorised access. Once the personal data provided are no longer necessary, they will be deleted from our files and the media on which the personal data supplied were collected will be destroyed or returned to the data subject, as appropriate, with no copies of that information being retained.

ERRORS

Although we endeavour to maintain the integrity of the SITE and other OFFERINGS, we make no warranty as to the accuracy or completeness of the SITE or other OFFERINGS. If you believe you have found an error on the SITE or in other OFFERINGS, please contact us on 691 30 89 / 691 31 62 / 530 33 35, including, if possible, a description of the error, its location in the URL and your contact details. We will make reasonable efforts to respond to your query.

DENIAL OF ACCESS TO THE SITE AND/OR THE SERVICES

PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S reserves the right to deny access to the site and/or the services, at any time and without prior notice, to any USER who breaches these GENERAL CONDITIONS or the PARTICULAR CONDITIONS applicable in each case.

APPLICABLE LAW

These Terms and Conditions of Use are governed by the laws of the Republic of Colombia. Any USER who contravenes the Terms and Conditions of Use set out in this document shall be subject to the civil and criminal penalties established by law.

COURSES AND WORKSHOPS BY PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S AND DHARANA S.A.S

Payment terms for credit or instalment plans on courses by PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S AND DHARANA S.A.S

When purchasing any of the courses offered by PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S AND DHARANA S.A.S under a credit or instalment plan, no interest or late-payment charges will be applied. However, by accepting this payment option the customer acknowledges and automatically accepts that a payment commitment and/or payment agreement is established in accordance with the legislation in force.

Should that agreement not be honoured, we reserve the right of admission to the modules, workshops, courses and/or similar activities until the outstanding obligation is settled, in accordance with the following legal provisions:

  • Article 560 of Law 1564 of 2012 (Colombian General Code of Procedure): «If the debtor fails to meet the obligations agreed in the payment arrangement, any of the creditors or the debtor themselves shall inform the conciliator of that situation in writing, giving a precise account of the facts constituting the breach.»
  • Article 1326 of the Colombian Commercial Code: Establishes that the parties must comply with the payment terms agreed in a contract, ensuring that the obligations undertaken are respected.
  • Article 4 of Law 1480 of 2011 (Colombian Consumer Statute): Sets out the consumer's right to receive clear, truthful and sufficient information about the goods and services purchased, including their financing terms.
  • Law 1916 of 2018: Reaffirms consumers' right to receive detailed information about payment terms and deadlines, guaranteeing transparency in commercial relationships.
  • By accepting a purchase under this arrangement, the customer undertakes to meet the payments agreed, acknowledging that failure to do so may result in restrictions on access to the services contracted, in accordance with the legislation in force.

Discounts on course purchases

Any discount on the purchase of courses is at the sole discretion of PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S AND DHARANA S.A.S; this means that PRODIMÉDICA NATURAL BIOENERGÉTICA SIU TUTUAVA S.A.S AND DHARANA S.A.S reserves the right to grant it or not, and doing so constitutes no obligation.
